of reservations and short-term rental of premises - PONIATOWSKI APARTMENTS, owned by P25 Sp. z o.o. in Przemyśl.
§ 1
GENERAL PROVISIONS
This regulation defines the rights and obligations of the Client and P25 Sp. z o.o., registered in the Entrepreneurs' Register kept by the District Court in Rzeszów - XII Economic Department of the National Court Register under number 0000937079, Tax Identification Number (NIP) 7952566965, as well as payment terms, complaints, liability, and reservation conditions.
The regulation is an integral part of the short-term rental agreement for premises offered by P25 Sp. z o.o. and concluded through the booking.com portal or the przemyslapartamenty.pl website. Making a reservation is synonymous with accepting the provisions of this Regulation, the content of which the Client can familiarize themselves with at the electronic address https://przemyslapartamenty.pl/regulamin and whose acceptance is confirmed by the appropriate statement on the reservation form.
Whenever the Regulation refers to:
- The Client - this shall mean a natural person with full legal capacity within the meaning of the Civil Code, a legal person, or an organizational unit referred to in art. 331 of the Civil Code, being a party to a short-term rental agreement for premises offered by P25 Sp. z o.o.
- PONIATOWSKI APARTMENTS - this shall mean the Service Provider, i.e., P25 S.p. z o.o. with its registered office in Przemyśl at ul. Aleksandra Fredry 1/11, 37-700 Przemyśl.
- Website - this shall mean the website: www.przemyslapartamenty.pl, owned by P25 Sp. z o.o., and the reservation platform available on it.
- Agreement - this shall mean the set of mutual rights and obligations of the parties arising from the short-term rental agreement for premises offered by P25 Sp. z o.o.
- Total Service Price - this shall mean the amount indicated during the reservation process, including all fees arising from the concluded Agreement.
- Apartment - this shall mean a furnished and equipped premises, specifically described in the offer presented on the website www.przemyslapartamenty.pl, which the Client rents for a temporary stay.
§ 2
SUBJECT OF THE AGREEMENT
The subject of the Agreement is the short-term rental of a furnished and equipped apartment offered by P25 Sp. z o.o. through the Internet Service or intermediaries in the conclusion of agreements with the Company, in particular on the www.booking.com portal.
P25 Sp. z o.o. is obliged to provide the Client with premises in accordance with the description contained on the Internet Service or the intermediary portal, within the time limits specified in the reservation, and the Client is obliged to pay the Total Service Price specified in the reservation process.
Making a reservation by the Client through the Internet Service or an intermediary portal with P25 Sp. z o.o. is equivalent to accepting these Regulations and concluding an Agreement for the short-term rental of premises between the Client and PONIATOWSKI Apartments.
§ 3
RESERVATION AND PAYMENT RULES
In the reservation process, the Client selects the premises offered by P25 Sp. z o.o. through the Internet Service or the intermediary portal, and then makes a reservation of the premises by completing a virtual reservation form available on the Internet Service or intermediary portals or makes a reservation by phone at +48 503 333 779.
The Client makes a reservation by specifying, under the offer presented on the Internet Service or the intermediary portal, the specific start date and end date of the stay. The stay is counted in days. In the case of making a reservation by phone, the reservation is made after receiving a reservation confirmation from P25 Sp. z o.o. to the Client's email address.
Each of the offered premises is intended for accommodation by a maximum number of persons specified in the reservation form. The number of persons staying in the premises is indicated by the Client during the reservation process: in the reservation form or by phone. This number must not exceed the maximum number designated for a given premises. Staying in the premises by a larger number of persons than indicated in the reservation form or as agreed by phone must be arranged directly with P25 Sp. z o.o. before the start of the stay and may result in an increase in the price of the premises or a refusal of reservation.
Confirmation of the reservation is made by sending an email to the email address provided by the Client during the reservation process, with information about the confirmation of the reservation, the determination of the Total Service Price, acceptance of the provisions of the Regulations, and the reservation date, as well as the bank account to which the Client is obliged to make a transfer through online payment (Przelewy 24).
Failure to make the payment referred to in para. 4 within 3 calendar days from the date of reservation will result in the cancellation of the reservation (withdrawal from the agreement without the need to set an additional deadline for performance). However, when the reservation is made three days before the stay or on the day of the stay, the payment for the entire value of the service must be made immediately, no later than before the start of the stay or, if agreed otherwise, no later than upon check-in in cash.
P24 Sp. z o.o. issues a VAT invoice each time after receiving payment in accordance with applicable regulations. The invoice is sent electronically to the email address provided by the Client.
The Client is obliged to provide information necessary for the reservation process (in particular, name and surname, address, contact phone number, email address), while making a statement that they are true.
§ 4
STAY CONDITIONS
The stay in the premises begins no earlier than at 2:00 PM on the first day specified in the Agreement and ends on the last day at 11:00 AM.
Check-in and check-out at the apartments can be done without the personal presence of the personnel of PONIATOWSKI Apartments.
On the day of the start of the stay, no later than 1:00 PM, the Client will receive access codes to the apartment. The codes will be sent to the email address provided by the Client and as an SMS to the phone number provided.
The keys to the apartment on the day of the start of the stay will be located in a key safe, marked with the apartment number, or will be handed over by the personnel of the apartments.
Leaving the premises after 11:00 AM on the last day of the stay is possible only after prior telephone agreement and obtaining consent from P25 Sp. z o.o. After exceeding the checkout time indicated above, P25 Sp. z o.o. has the right to charge an additional fee for extending the stay, amounting to PLN 30 for each started hour of the stay. Payment for the extension of the stay will be made by the Client upon checking out of the apartment.
There is a nighttime silence rule in the premises from 10:00 PM to 6:00 AM. In addition, the Client is obliged to comply with fire regulations.
Check-in of the Client between 10:00 PM - 12:00 AM is possible after prior notification and consent by P25 Sp. z
o.o. In such a case, an additional fee of PLN 50 is charged. Check-in after 12:00 AM is not possible.
§ 5
CANCELLATION AND WITHDRAWAL FROM THE AGREEMENT
Cancellation of the reservation and withdrawal from the Agreement may occur no later than 30 days before the start of the stay.
In the event of a refund of the booking, the payment made by the Client for the stay will be refunded to the bank account provided by the Client. In the case of a refund of the booking, the cost of return transfer will be borne by the Client.
Withdrawal from the Agreement is only possible by sending an email to the following address: biuro@przemyslapartamenty.pl or by calling the P25 Sp. z o.o. office at +48 503 333 779. In the case of cancellation or withdrawal from the Agreement, the date of receipt of the email by P25 Sp. z o.o. or the date of receiving the phone call is taken into account.
In the event of withdrawal from the Agreement, the amount to be returned to the Client is determined as follows:
- If the Client withdraws from the Agreement no later than 30 days before the start of the stay, P25 Sp. z o.o. will refund the Client the entire amount paid by the Client.
- If the Client withdraws from the Agreement no later than 14 days before the start of the stay, P25 Sp. z o.o. will refund 50% of the amount paid by the Client.
- If the Client withdraws from the Agreement no later than 7 days before the start of the stay, P25 Sp. z o.o. will refund 25% of the amount paid by the Client.
- In the event of withdrawal from the Agreement later than 7 days before the start of the stay, the Client is not entitled to a refund of the amount paid.
P25 Sp. z o.o. reserves the right to cancel the reservation in the event of a gross violation of the Regulations or non-compliance with the rules of social coexistence by the Client or persons staying with the Client.
§ 6
COMPLAINTS
The Client has the right to file a complaint about the quality of services provided. Complaints should be submitted in writing to the following email address: biuro@przemyslapartamenty.pl or by phone at +48 503 333 779.
P25 Sp. z o.o. will consider the complaint within 14 days from the date of its receipt.
The Client agrees to the processing of their personal data for the purpose of considering the complaint and issuing a response.
§ 7
LIABILITY
P25 Sp. z o.o. does not take responsibility for any items left by the Client in the premises during or after the stay.
The Client is fully financially responsible for any damage or destruction of equipment and technical devices located in the apartment, including lost keys or remote controls.
§ 8
FINAL PROVISIONS
The Regulations are available on the website www.przemyslapartamenty.pl and at the P25 Sp. z o.o. office in Przemyśl.
The Regulations are binding for both parties to the Agreement from the moment of making the reservation.
The Regulations enter into force on the day of being placed on the www.przemyslapartamenty.pl website.
In matters not covered by the Regulations, the relevant provisions of Polish law shall apply, in particular the Civil Code and the Act on Tourist Services.
Any disputes arising between P25 Sp. z o.o. and the Client who is not a consumer within the meaning of the Civil Code, in connection with the conclusion and execution of the Agreement covered by the Regulations, will be considered by the court having jurisdiction over the registered office of P25 Sp. z o.o.
The client who is a consumer has the right to use extrajudicial methods of dealing with complaints and redress. To obtain detailed information on the possibilities of using extrajudicial means of dealing with complaints and redress, the Client, who is a consumer, can contact the local Consumer Ombudsman or the relevant regional Inspectorate of Trade Inspection.
